AN ACT AMENDING TITLE 12, CHAPTER6, ARTICLE 12, ARIZONA REVISED STATUTES, BY ADDING SECTION12-713; RELATING TO IMMUNITIES FOR CIVIL DAMAGES.

Be it enacted by the Legislatureof the State of Arizona:

Section 1. Title 12, chapter 6,article 12, Arizona Revised Statutes, is amended by addingsection 12-713, to read:

12-713. Emergency call system;qualified immunity; exceptions

A PERSON, PRIVATE ENTITY,PUBLIC ENTITY OR EMPLOYEE OF A PRIVATE OR PUBLIC ENTITY IS NOTLIABLE FOR CIVIL DAMAGES THAT RESULT FROM AN ACT OR OMISSION INCONNECTION WITH DEVELOPING, ADOPTING, OPERATING, IMPLEMENTING,ESTABLISHING OR PARTICIPATING IN THE 9-1-1 EMERGENCY TELEPHONESYSTEM OR A SIMILAR EMERGENCY DISPATCH SYSTEM UNLESS THE ACT OROMISSION OF THE PERSON, ENTITY OR EMPLOYEE CONSTITUTES GROSSNEGLIGENCE OR WILLFUL OR WANTON MISCONDUCT

AN ACT AMENDING SECTION 42-1471,ARIZONA REVISED STATUTES; RELATING TO TELECOMMUNICATION SERVICESEXCISE TAX.

Section 1. Section 42-1471,Arizona Revised Statutes, is amended to read:

42-1471. Definitions

In this chapter, unless thecontext otherwise requires:

1. “Customer” means aperson or entity in whose name telephone or telecommunicationservices are rendered, as evidenced by a signature on anapplication or contract for service or by receipt or payment ofbills regularly issued in the person’s or entity’s name.

2. “Emergencytelecommunication services” means telecommunication servicesor systems that use number 911 or a similarly designatedtelephone number for emergency calls.

3. “Exchange accessservices” means telephone or telecommunication exchangeaccess lines or channels which provide local access from the premisesINSTRUMENT of a customer to the local telecommunicationsnetwork to effect the transfer of information.

4. “‘Provider” means apublic service corporation offering telephone ortelecommunications services pursuant to title 40, which providesexchange access services.
