SENATE RESOLUTION 53

A RESOLUTION

Creating the Senate 911 Systems Funding StudyCommittee; and for other purposes.

WHEREAS, governments currently provide 911service through the assessment and collection of charges onland-line telephones; and

WHEREAS, wireless, cellular telephones are notsubject to 911 charges but nonetheless receive the benefits of911 service; and

WHEREAS, wireless communications and digitalservices compose an ever increasing segment of the communicationsmarket, the ability of governments to provide and fund 911emergency service is rapidly decreasing.

NOW, THEREFORE, BE IT RESOLVED BY THE SENATEthat there is created the Senate 911 Systems Funding StudyCommittee to be composed of five members of the Senate to beappointed by the President of the Senate. The President of theSenate shall designate a member of the committee as chairpersonof the committee. The chairperson shall call all meetings of thecommittee.

BE IT FURTHER RESOLVED that the committee shallundertake a study of the conditions, needs, issues, and problemsmentioned above or related thereto and recommend any actions orlegislation which the committee deems necessary or appropriate.The committee may conduct such meetings at such places and atsuch times as it may deem necessary or convenient to enable it toexercise fully and effectively its powers, perform its duties,and accomplish the objectives and purposes of this resolution.The members of the committee shall receive the allowanceauthorized for legislative members of interim legislativecommittees but shall receive the same for not more than five daysunless additional days are authorized. The funds necessary tocarry out the provisions of this resolution shall come from thefunds appropriated to the Senate. In the event the committeemakes a report of its findings and recommendations, withsuggestions for proposed legislation, if any, such report shallbe made on or before December 1, 1997

The committee shall stand abolished on December1, 1997.

HOUSE BILL 812

A BILL TO BE ENTITLED

AN ACT

To specify certain requirements with respect totraining in the use of telecommunications devices for the deaf(TDD’s) for dispatch center communications officers; to amendCode Section 35-8-23 of the Official Code of Georgia Annotated,relating to training and certification of public safetycommunications officers, so as to require such training for newlycertified communications officers to provide for a course of suchtraining for previously certified communications officers; toamend Chapter 60 of Title 36 of the Official Code of GeorgiaAnnotated; relating to provisions of law applicable to countiesand municipalities, so as to require that dispatch centers havetrained communications officers on staff; to amend Code Section46-5-133 of the Official Code of Georgia Annotated, relating tothe imposition of fees for emergency “911 “systems, so as to provide that after a certain date such fees maybe imposed only for support of dispatch centers in compliancewith the foregoing requirements; to provide for related matters;to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERALASSEMBLY OF GEORGIA

SECTION 1.

Code Section 35-8-23 of the Official Code ofGeorgia Annotated, relating to training and certification ofpublic safety communications officers, is amended by adding atits end a new subsection (d) to read as follows:

“(d) On and after July 1,1997, the basictraining course for communications officers shall includetraining in the use of telecommunications devices for the deaf(TDD’s), and no person shall on or after that date be certifiedby the council under this Code section unless such person hassatisfactorily completed such training. The council shall alsoestablish rules for approval of a separate training course in theuse of TDD’s for communications officers whose earlier basictraining course under this Code section did not include suchtraining, and such earlier certified communications officers whosatisfactorily complete such TDD training shall be so certifiedfor purposes of compliance with Code Section 36-60-19.”

SECTION 2.

Chapter 60 of Title 36 of the Official Code ofGeorgia Annotated, relating to provisions of law applicable tocounties and municipalities, is amended by adding at its end anew Code Section 36-60-19 to read as follows:

“36-60-19

(a) On and after January 1, 1998 every dispatchcenter operated by any county or municipality to receive,process, or transmit public safety information and dispatch lawenforcement officers, firefighters, medical personnel, oremergency management personnel shall comply with the requirementsof this Code section. Each such dispatch center shall have onduty at all times at least one communications officer who iscertified as having been trained in the use of telecommunicationsdevices for the deaf (TDD’s), as provided for in subsection (d)of Code Section 35-8-23. However, a dispatch center which isstaffed by six or fewer communications officers shall beconsidered in compliance with this Code section until January 1,1999, if such dispatch center has on staff at least onecommunications officer who is so certified.

(b) On and after January 1, 1998, no monthly’911′ charge provided for in Code Section 46-5-133 may be imposedfor the support of any dispatch center unless such dispatchcenter is in compliance with the requirements of this Codesection.”

SECTION 3.

Code Section 46-5-133 of the Official Code ofGeorgia Annotated, relating to the imposition of fees foremergency ‘911’ systems, is amended by adding at its end a newsubsection (c) to read as follows:

“(c) On and after January 1, 1998, nomonthly ‘911’ charge provided for in this Code section may beimposed or continue to be imposed unless each dispatch centerfunded in whole or in part from such charges is in compliancewith Code Section 36-60-19, relating to required TDD training forcommunications officers.

SECTION 4.

All laws and parts of laws in conflict withthis Act are repealed.

A BILL TO BE ENTITLED

AN ACT

To amend Code Section 46-5-134 of the OfficialCode of Georgia Annotated, relating to the billing of telephonesubscribers for an emergency telephone number “911 system,so as to authorize payment, from an Emergency Telephone SystemFund maintained by a local government, of certain personnel andsupply costs and the cost of leasing, purchasing, or maintainingcertain equipment; to provide for an effective date; to repealconflicting laws; and for other purposes.

TO BE ENACTED BY THE GENERALASSEMBLY OF GEORGIA

SECTION 1.

Code Section 46-5-134 of the Official Code ofGeorgia Annotated, relating to the billing of telephonesubscribers for an emergency telephone number “911”system, is amended by striking in its entirety subsection (e) andinserting in lieu thereof a new subsection (e) to read asfollows:

“(e) Money from the Emergency TelephoneSystem Fund shall be used only to pay for:

(1) The lease, purchase, or maintenance ofemergency telephone equipment, including necessary computerhardware, software, and data base provisioning; addressing; andnonrecurring costs of establishing a ‘911’ system;

(2) The rates associated with the servicesupplier’s ‘911’ service and other service supplier’s recurringcharges;

(3) The actual cost of salaries of employeeshired by local government solely for the operation andmaintenance of the emergency ‘911’ system , INCLUDING THEACTUAL COST OF SALARIES OF SUCH EMPLOYEES WHO ANSWER NONEMERGENCYCALLS RECEIVED BY THE EMERGENCY ‘911’ SYSTEM;

(4) Office supplies of the public safetyanswering points used directly in providing emergency ‘911’system services;

(5) The cost of leasing or purchasing abuilding used as a public safety answering point. The moneys fromthe fund cannot be used for the construction or lease of anemergency ‘911’ system building until the local government hascompleted its street addressing plan;

(6) THE LEASE, PURCHASE, OR MAINTENANCE OFCOMPUTER HARDWARE AND SOFTWARE USED IN A COMPUTER AIDED ORCOMPUTER ASSISTED DISPATCH SYSTEM AT A PUBLIC SAFETY ANSWERINGPOINT;

(7) THE LEASE, PURCHASE, OR MAINTENANCE OFRADIOS, RADIO CONSOLES AND OF ASSOCIATED DISPATCH CENTEREQUIPMENT USED FOR THE DISPATCH OF ‘911’ CALLS;

(8) THE LEASE, PURCHASE, OR MAINTENANCE OFLOGGING RECORDERS USED AT A PUBLIC SAFETY ANSWERING POINT TORECORD TELEPHONE AND RADIO TRAFFIC;

(9) THE COST OF TRAINING AND ANNUALIN-SERVICE TRAINING REQUIRED BY CODE SECTION 35-8-23; AND

(10) SUPPLIES DIRECTLY RELATED TO PROVIDINGEMERGENCY ‘911’ SYSTEM SERVICES, INCLUDING THE COST OF PRINTINGEMERGENCY ‘911’ PUBLIC EDUCATION MATERIALS.

SECTION 2.

Notwithstanding the provisions of Code Section1-3-4.1, this Act shall become effective on July 1, 1997.

SECTION 3.

All laws and parts of laws in conflict withthis Act are repealed.
